Who is responsible for your data?

Ecomtierra Group SL (Mediterrano Pilates) is the controller of your personal data. You can contact us at hola@mediterranopilates.com.

What data do we collect and why?

Through our request form we collect your name, your email address, your studio name, the products you are interested in, your message, the logo you upload and (optionally) your Instagram account and phone number. We also record which ad or link brought you to the site (for example, an Instagram ad). If you contact us via WhatsApp or email, we process your name, your number or email address and the content of the conversation. We use this data only to:

  • respond to your request and send you a mockup and a quote;
  • process, deliver and invoice your order;
  • stay in touch with you about working together;
  • measure which ads and pages are effective, but only if you consent to this via the cookie banner.

On what legal basis?

  • Your request and order: taking steps at your request before entering into a contract, and performing the contract (Art. 6(1)(b) GDPR).
  • Contact about working together: our legitimate interest in maintaining business relationships (Art. 6(1)(f) GDPR). If you would rather not hear from us, just tell us and we will stop straight away.
  • Invoices and accounting: our legal obligations (Art. 6(1)(c) GDPR).
  • Analytics and advertising cookies: your consent (Art. 6(1)(a) GDPR). You can withdraw your consent at any time.

We do not send newsletters without your consent and we never sell your data to third parties. We do not make decisions about you based solely on automated processing.

How long do we keep your data?

If your request does not lead to us working together, we delete your data no later than two years after our last contact. If we do work together, we keep your data for as long as we work together. We keep invoices and accounting records for as long as Spanish law requires (generally six years). We use your logo only for your products.

Who else processes your data?

We work with a small number of carefully chosen service providers, who process your data only on our behalf:

  • Netlify, Inc. (United States): website hosting and receipt of request form submissions.
  • Google Ireland Ltd.: Google Analytics 4, only with your consent, to understand in aggregate how the site is used.
  • Meta Platforms Ireland Ltd.: the Meta Pixel, only with your consent, to measure the results of our ads on Facebook and Instagram.
  • WhatsApp Ireland Ltd.: if you contact us via WhatsApp, the conversation takes place through WhatsApp.

International transfers

Some of these providers may transfer data to the United States. Such transfers take place on the basis of the EU-US Data Privacy Framework (and, for data from the United Kingdom, the UK Extension to it), where the recipient is certified under it, or on the basis of the European Commission's standard contractual clauses. You can find more information in the privacy policies of these providers.

Cookies

This website uses analytics and advertising cookies only with your consent. On your first visit, a banner lets you accept or decline them. If you decline, the site works in exactly the same way. Without your consent, we only store what is strictly necessary.

  • _ga and _ga_* (Google Analytics 4): distinguish visitors and sessions. Retention: up to 2 years. Only with consent.
  • _fbp (Meta Pixel): measures the results of ads. Retention: 3 months. Only with consent.
  • mp_cookie_consent (local storage in your browser): remembers your cookie choice, so that we do not need to ask you again. Functional.
  • mp_lang_choice (local storage in your browser): remembers your language choice. Functional.

You can change your choice or withdraw your consent at any time via the Cookies link at the bottom of the homepage, by clearing this site's data in your browser, or by emailing us at hola@mediterranopilates.com.

Your rights

You have the right to access, rectify and erase your data, to restrict its processing and to data portability. You can withdraw any consent you have given at any time, without affecting the lawfulness of processing before the withdrawal.

Right to object: where we process your data on the basis of our legitimate interest (Art. 6(1)(f) GDPR), you can object to that processing at any time on grounds relating to your particular situation. You can always object to the use of your data for direct marketing, and we will then stop that use.

Email us at hola@mediterranopilates.com and we will reply within one month. If you are unhappy with how we handle your data, you can lodge a complaint with the Spanish Data Protection Agency (AEPD, aepd.es), our lead supervisory authority, or with the authority in your own country: in the United Kingdom the Information Commissioner's Office (ICO, ico.org.uk), in Ireland the Data Protection Commission (dataprotection.ie).

Terms & conditions

Applicable to all quotes and deliveries to business clients

1. Scope

These terms apply to all offers, mockups, quotes and contracts between Ecomtierra Group SL (Mediterrano Pilates) and business clients, such as Pilates and yoga studios. We contract exclusively with businesses acting in the course of their trade or profession; consumers cannot order from us. Prices are stated excluding VAT unless indicated otherwise.

These terms are always available on this page. We refer to them in every quote and will send them to you free of charge on request, including as a PDF. By approving the quote, you accept these terms. Your own purchasing or other terms apply only if we have accepted them in writing in advance.

2. Mockups and quotes

Mockups and quotes are free and without obligation. An order is only placed once you have approved the final design in writing (by email) and we have confirmed the order.

3. Personalisation and approval

All products are made specifically for your studio, with your logo and your colours. By approving the mockup, you accept the design, the colours and the specifications. Slight colour differences between the screen and the finished product may occur; within a reasonable tolerance, these do not constitute a defect. Pantone matching keeps them to a minimum.

4. No right of withdrawal on personalised products

Personalised products cannot be exchanged or returned. Because each product is made to your specifications and with your logo, it cannot be resold to anyone else. The law also recognises this: goods made to the buyer's specifications or clearly personalised are excluded from the right of withdrawal (Article 16(c) of Directive 2011/83/EU and Article 103(c) of the Spanish TRLGDCU). In addition, our deliveries are business-to-business (B2B) transactions, to which the consumer right of withdrawal does not apply.

5. Quality and defects

The absence of a right of withdrawal does not mean there is no guarantee. If you receive products with a manufacturing fault, or the delivery does not match the approved mockup, please tell us within 14 days of delivery by email to hola@mediterranopilates.com, with photos. If the colour does not match your approved design, or there is a manufacturing fault, we will remake the products concerned free of charge. If that is not possible, we will credit the relevant part of the invoice.

6. Delivery

The indicative delivery time is approximately four weeks after design approval and payment. Shipping is free across Europe, including the United Kingdom. Timeframes are indicative; delays outside our control (such as customs or transport) do not entitle you to cancel or claim compensation, although we will always keep you informed. Any import duties or taxes in the destination country are your responsibility. For orders to the United Kingdom, this includes import VAT and any customs duties.

7. Payment

Payment terms are agreed for each order and stated on the invoice. For first orders, we may ask for full or partial payment in advance before production begins.

8. Liability

Our liability is limited to the invoiced amount of the order concerned. We are not liable for indirect or consequential loss, such as loss of income or profit.

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

9. Intellectual property

You confirm that you have the right to use the logo and brand material you provide to us. Your logo remains your property; we use it only for your products and, only with your consent, as a reference in our portfolio.

10. Governing law

All contracts are governed by Spanish law, without prejudice to any mandatory provisions that apply in your country. Any dispute that cannot be resolved amicably will be submitted to the courts of Spain.

11. Informational content on this website

The information published on this website (including the blog, product pages and sector pages) is general and for information purposes only. It does not constitute legal, tax, medical or any other professional advice, and it does not replace the guidance of your professional body, trade association or adviser. Where we refer to regulations, we do so on the basis of Spanish law and our own interpretation as at the date of publication; regulations can change and may differ in your country. Before making decisions based on this content, please check it with a qualified professional. Ecomtierra Group SL accepts no liability for decisions taken solely on the basis of the information on this website.
